Circuit upheld the First Amendment rights of two pro-life organizations that sought to chalk a pro-life message on a city sidewalk.\u201d While the D.C. government may appeal the 3-0 decision, ask for a full hearing of the appeals court, or even go to the Supreme Court, it\u2019s likely that&#0160;<em>FREDERICK DOUGLASS FOUNDATION, INC., ET AL., APPELLANTS&#0160;&#0160;v. DISTRICT OF COLUMBIA, APPELLEE,<\/em>&#0160;will proceed.&#0160;<strong><a href=\"https:\/\/nam10.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fstudentsforlife.org%2F2023%2F08%2F15%2Ffree-speech-victory-circuit-court-finds-evidence-of-viewpoint-discrimination-for-excluding-sflas-pro-life-perspective-in-washington-d-c-case%2F&amp;data=05%7C01%7Ccwharton%40studentsforlife.org%7C23243ef2d9394e5aed9c08db9db8cd0e%7Cb3f92ab929b141449c57d11e0e7a368a%7C0%7C0%7C638277189286815445%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000%7C%7C%7C&amp;sdata=nop7FJsFsbSWsXw0wuY5C%2B2xYt8G3Eqr8iSmeu50Kbo%3D&amp;reserved=0\">Learn more about the case here.<\/a><\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>The events as reported in the decision<\/strong>: \u201cIn the summer of 2020, thousands of protesters flooded the streets of the District to proclaim \u2018Black Lives Matter.\u2019 Over several weeks, the protesters covered streets, sidewalks, and storefronts with paint and chalk. The markings were ubiquitous and in open violation of the District\u2019s defacement ordinance, yet none of the protesters were arrested. During the same summer, District police officers arrested two pro-life advocates in a smaller protest for chalking \u2018Black Preborn Lives Matter\u2019 on a public sidewalk.&#0160;<\/p>\n<p>Here&#39;s the Journal:<\/p>\n<p><a href=\"https:\/\/www.wsj.com\/articles\/frederick-douglass-foundation-v-d-c-neomi-rao-protesters-defacement-law-washington-muriel-bowser-b6cb39af?mod=MorningEditorialReport&amp;mod=djemMER_h\"> &#8230; People also plastered construction scaffolding with graffiti, murals, and photographs that included \u201cBlack Lives Matter\u201d messages. These protesters didn\u2019t obtain permits for their graffiti, and none were punished for violating the defacement law. So when anti-abortion groups planned a small rally to proclaim \u201cBlack Pre-Born Lives Matter,\u201d a police officer gave them verbal permission to paint their message on the street because he believed the mayor had opened public property to political markings. <\/a><\/p>\n<p class=\"css-k3zb6l-Paragraph e1e4oisd0\" data-type=\"paragraph\" style=\"padding-left: 40px;\">He was mistaken. When two pro-life supporters tried to chalk \u201cBlack Pre-Born Lives Matter\u201d on the sidewalk, they were arrested. Pro-life groups were also denied permission at another rally to mark up the street or sidewalk. They sued the city for violating the First Amendment by selectively enforcing its defacement law based on viewpoint.<\/p>\n<p class=\"css-k3zb6l-Paragraph e1e4oisd0\" data-type=\"paragraph\" style=\"padding-left: 40px;\">A D.C. Circuit panel ruled 3-0 in their favor. While governments enjoy discretion over when and how they prosecute laws, \u201cthe executive cannot selectively enforce the law in a way that violates the Constitution,\u201d Judge Neomi Rao wrote. This means governments must treat similarly-situated individuals and groups similarly when they restrict speech.<\/p>\n<p class=\"css-k3zb6l-Paragraph e1e4oisd0\" data-type=\"paragraph\" style=\"padding-left: 40px;\">\u201cThe government may not play favorites in a public forum\u2014permitting some messages and prohibiting others,\u201d Judge Rao stressed.
