Of course they&#39;d have trouble going after them with the FACE law (Freedom of Access to Clinic Entrances) since they didn&#39;t block anything. Between the two priests is their attorney Chris Kachouroff.<\/em><\/p>\n<p><a href=\"https:\/\/www.lifesitenews.com\/news\/catholic-priests-activists-walk-free-after-trial-for-pro-life-witness-insid\">Catholic priests, activists walk free after trial for pro-life witness inside abortion center<\/a>&#0160;<\/p>\n<p style=\"padding-left: 30px;\">Six pro-life activists, including two Catholic priests, walked free today after facing obstruction of justice and trespassing charges for refusing to leave an abortion facility waiting room.<\/p>\n<p style=\"padding-left: 30px;\">The pro-life activists were found guilty of trespassing and each given a $500 suspended fine. If they don\u2019t trespass inside the abortion facility for the next year and maintain good behavior, the fine will be waived. They were found not guilty of obstruction of justice.<\/p>\n<p style=\"padding-left: 30px;\"><a href=\"https:\/\/www.lifesitenews.com\/news\/update-priests-pro-lifers-released-from-jail-after-rescue-at-abortion-cente\">Inside that waiting room on September 15, 2017<\/a>, they gave pregnant women roses and encouraged them to choose life. Police removed the activists from the facility, Alexandria Women\u2019s Health Clinic, as they passively resisted arrest. The activists called this a \u201cRed Rose Rescue.\u201d It was because they passively resisted arrest, requiring wheelchairs to haul them out of the abortuary, that the pro-life activists were charged with obstruction of justice.<\/p>\n<p style=\"padding-left: 30px;\">One of the priests, Father Fidelis Moscinski of the Franciscan Friars of the Renewal (CFR), told presiding Judge Donald Paddock that he would not pay any fines because he considers them unjust, and would similarly consider any jail time to which he was sentenced \u201cillegal.\u201d<\/p>\n<p style=\"padding-left: 30px;\">\u201cI consider this Court\u2019s judgement of me as guilty invalid and therefore any subsequent incarceration illegal,\u201d he said.<\/p>\n<p style=\"padding-left: 30px;\">Appearing in Alexandria General District Court alongside Fr. Fidelis were his co-rescuers, Father Stephen Imbarrato of Priests for Life, Joan Andrews Bell, Julia Haag, Bonnie Borel Donahue, and Joan McKee.<\/p>\n<p style=\"padding-left: 30px;\">Fr. Fidelis is a soft-spoken, gentle, serene friar who wears sandals without socks year-round as part of his religious habit.&#0160;&#0160;<\/p>\n<p style=\"padding-left: 30px;\">Fr. Imbarrato is known as the \u201cprotest priest\u201d and participates in pro-life activism around the country. He has offered Masses on EWTN and is a&#0160;<a href=\"https:\/\/www.lifesitenews.com\/news\/meet-the-priest-who-regrets-his-role-in-an-abortion-who-is-speaking-at-this\">post-abortive father himself<\/a>.<\/p>\n<p style=\"padding-left: 30px;\">Haag, Donahue, and McKee were described as \u201cseniors\u201d during the trial. Haag and Donahue sometimes pray outside Planned Parenthood\u2019s Washington, D.C. flagship abortion facility.<\/p>\n<p style=\"padding-left: 30px;\"><a href=\"https:\/\/www.lifesitenews.com\/tags\/tag\/joan+andrews+bell\">Bell<\/a> is a <a href=\"https:\/\/www.lifesitenews.com\/news\/us-pro-life-heroine-joan-andrews-bell-miraculously-released-from-prison\">seasoned pro-life activist<\/a> who has participated in dozens of rescue-style operations across the country. The prosecutor only listed some of Bell&#39;s previous convictions as she argued for Bell and others who have done past rescues to be punished more harshly.<\/p>\n<p style=\"padding-left: 30px;\">Lauren Handy of Mercy Missions told LifeSiteNews this was likely because it would have taken too long to list all of Bell\u2019s life-saving rescues.<\/p>\n<p style=\"padding-left: 30px;\">Paddock did not sentence Bell more harshly than the others.<\/p>\n<p style=\"padding-left: 30px;\">Canadian pro-life activist Mary Wagner, who has conducted similar rescues in her own country and served jail time for them, was present in court today to observe the trial.<\/p>\n<p style=\"padding-left: 30px;\">\u201cI\u2019m glad we did what we did,\u201d McKee told LifeSiteNews. \u201cThe babies just matter so much\u2026I hope we can keep up and eliminate the killing of pre-born babies and help to educate people to love their children.\u201d<\/p>\n<p style=\"padding-left: 30px;\">\u201cI\u2019m very hesitant to rejoice in victory \u2013 so to speak \u2013 because I don\u2019t think there\u2019s really any victories or rejoicing until pre-born child killing comes to an end,\u201d Fr. Imbarrato told LifeSiteNews. \u201cThis is just a small hurdle that we got past.\u201d<\/p>\n<p style=\"padding-left: 30px;\">\u201cI think it shows that God wants us to continue discerning and praying about Red Rose Rescues and surely that\u2019s what\u2026my conscience has come to\u201d make me believe, the priest concluded.<\/p>\n<p style=\"padding-left: 30px;\">None of the activists were charged under <a href=\"https:\/\/www.justice.gov\/crt\/statute-18-usc-248\">FACE, the Clinton-era Freedom of Access to Clinic Entrances Act<\/a> that makes blocking abortion facility entrances severely punishable under federal law.<\/p>\n<h4 style=\"padding-left: 30px;\">Employees hesitant to say Alexandria Women&#39;s Health Clinic is an abortion facility<\/h4>\n<p style=\"padding-left: 30px;\">Judge Paddock allowed defense attorney Chris Kachouroff to argue that what the six activists did on September 15 was necessary to save the lives of other humans. He ultimately said the argument wasn\u2019t applicable to the trespassing charge.<\/p>\n<p style=\"padding-left: 30px;\">During his cross-examination of Alexandria Women\u2019s Health Clinic receptionist Jerilyn, Kachouroff asked her to specify what types of services the facility offers. She was extremely hesitant to admit that the \u201cservices\u201d her employer commits are abortions.<\/p>\n<p style=\"padding-left: 30px;\">Kachouroff put Catherine Flandez, the facility\u2019s head nurse and assistant administrator, on the spot during her cross-examination as he asked her if the \u201cservices\u201d being provided were for the mother or the fetus.<\/p>\n<p style=\"padding-left: 30px;\">Such questions \u201cinherently assume a view of the world\u201d not compatible with the witness\u2019s worldview, said Judge Paddock. But he allowed Kachouroff to press Flandez on the issue slightly.<\/p>\n<p style=\"padding-left: 30px;\">&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;<\/p>\n<p style=\"padding-left: 30px;\">\u201cWomen\u2019s Health Clinic, Inc. is proud to be the first choice in gynecology and abortion services for women in the Virginia, Maryland, Washington, D.C. and West Virginia area,\u201d its website, which prominently advertises abortion, says.<\/p>\n<p style=\"padding-left: 30px;\">Officer Jonathan Lopez, one of the responding officers, said that he repeatedly told the six pro-lifers they \u201cneeded to vacate the premises.\u201d He testified that they told him they wouldn\u2019t leave unless the facility closed for the day and stopped \u201ckilling babies.\u201d<\/p>\n<p style=\"padding-left: 30px;\">Lopez was the officer who took Fr. Imbarrato into custody.<\/p>\n<h4 style=\"padding-left: 30px;\">\u2018We heard that at Nuremberg\u2019<\/h4>\n<p style=\"padding-left: 30px;\">Kachouroff\u2019s closing statement focused on Virginia\u2019s fetal homicide law and how the six pro-lifers were acting in necessity to defend others from being killed.<\/p>\n<p style=\"padding-left: 30px;\">Section 18.2-32.2 of the Virginia state code of law prohibits fetal homicide and allows those who kill a fetus to be charged with doing so.<\/p>\n<p style=\"padding-left: 30px;\">Judge Paddock didn\u2019t think it was an unfair argument, although he said general district court was an unusual place for this kind of debate to take place. But these cases have to start somewhere, he said, so he was willing to entertain the argument.<\/p>\n<p style=\"padding-left: 30px;\">Kachouroff noted that no officers intervened on behalf of the pre-born humans even though the pro-life activists told them babies were being killed.<\/p>\n<p style=\"padding-left: 30px;\"><strong>\u201cWe heard that at Nuremberg,\u201d he said.<\/strong><\/p>\n<p style=\"padding-left: 30px;\">Kachouroff argued that civil authorities have a duty to protect the lives of their fellow humans. He said that the judge would have to say that a fetus is not a person if he were to reject such arguments.&#0160;&#0160;<\/p>\n<p style=\"padding-left: 30px;\">Kachouroff then quoted Martin Luther King, Jr., who said that there can be a \u201cmoral responsibility\u201d to disobey unjust laws. The six red rose rescuers don\u2019t think laws against trespassing are unjust, he explained, but rather think that laws allowing other human beings to be killed through abortion are unjust.<\/p>\n<p style=\"padding-left: 30px;\">\u201cMy clients were expressing the highest respect for the law,\u201d he said. They were there not to trespass but to \u201cstop the killings of babies.\u201d<\/p>\n<p style=\"padding-left: 30px;\">Praying, distributing roses, and giving abortion-minded women pamphlets is \u201cnot what\u2019s encompassed by defense of others,\u201d the prosecutor argued. She said an example of the \u201cdefense of others\u201d would be if someone acted to stop another who had pulled out a knife.<\/p>\n<p style=\"padding-left: 30px;\">&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;&gt;<\/p>\n<div class=\"article-text-wrapper\" style=\"padding-left: 30px;\">\n<h4 style=\"padding-left: 30px;\"><strong>As a Catholic priest, I must say to this Court that abortion is murder\u2019<\/strong><\/h4>\n<p style=\"padding-left: 30px;\">Judge Paddock said that the law the pro-lifers were charged with violating was not a segregation law, but rather was \u201cthe law that prohibits people remaining on the land of another\u201d after being asked to leave.<\/p>\n<p style=\"padding-left: 30px;\">\u201cThe defense of others I find is inapplicable in the case at hand,\u201d he said. \u201cI\u2019m in no way attempting to&#8230;adjudicate the claims of the defendants.\u201d<\/p>\n<p style=\"padding-left: 30px;\">Judge Paddock said he simply saw it as a trespassing case and would treat it as such.<\/p>\n<p style=\"padding-left: 30px;\">\u201cI think there needs to be punishment, your honor,\u201d the prosecutor said.<\/p>\n<p style=\"padding-left: 30px;\">Judge Paddock then ordered the six pro-lifers to reappear in court on November 20, 2018. Provided they don\u2019t enter the Alexandria abortion facility again, at that time their $500 fines will be rescinded.<\/p>\n<p style=\"padding-left: 30px;\">\u201cYour Honor, a unique human individual begins to exist at the moment of conception,\u201d Fr. Fidelis told Judge Paddock in a prepared statement. \u201cIn a sane, civilized society that new human being would have his or her right to life clearly recognized in the law.\u201d<\/p>\n<p style=\"padding-left: 30px;\">\u201cBut we do not live in a sane, civilized society,\u201d he said. \u201cSince<em> Roe v. Wade<\/em> in 1973, we live in a nation, Your Honor, that has permitted the legal destruction of millions of innocent children.\u201d<\/p>\n<p style=\"padding-left: 30px;\">\u201cAs a Catholic priest, I must say to this Court that abortion is murder and no law or court decision can make legitimate what is intrinsically evil,\u201d Fr. Fidelis continued. \u201cLegalized abortion is an abomination in the eyes of God.\u201d<\/p>\n<p style=\"padding-left: 30px;\">Speaking louder but still in his signature gentle manner, Fr. Fidelis said, \u201cnow is the time for all of us to repent of our complicity in this national evil.\u201d<\/p>\n<p style=\"padding-left: 30px;\">\u201cIt is time to seek forgiveness from God, in the name of His Son, Jesus Christ,\u201d he said. \u201cIt is not too late to turn away from sin and begin to respect the gift of life and the laws of God.\u201d<\/p>\n<p style=\"padding-left: 30px;\">\u201cIn finding me guilty, this Court has refused to recognize the humanity and value of pre-born children,\u201d Fr.
